Geraldine Ssali
Civil division of High Court has ordered NSSF to pay its Deputy Managing Director Geraldine Ssali Busuulwa legal costs after the board sent her into forced leave in 2016.
In his ruling, Justice Stephen Musota, the head of the civil division of the High court, describe the NSSF board’s decision to send Ssali into forced leave as ‘illegal, irrational and procedurally improper’.
It further adds that the board had no powers to send Ssali into forced leave since powers of disciplining her reside with the minister of finance.
In the same plea, Ms Geradine Ssali demanded for Shs 200m court award and Shs1billion compensation for her wrongful interdiction which the organization has to pay.
Ms Ssali sued NSSF, the board chairman Patrick Kaberenge and the managing director Richard Byarugaba for contempt of a court ordered which cancelled her suspension and reinstated her in office pending investigations into her alleged insubordination.
Ms Ssali, Mr Byarugaba, Kaberenge and Finance minister Mr Matia Kasaija held a meeting and resolved that she be reinstated but on condition that she withdraws all the cases against NSSF in the High Court.
