The Court of Appeal has this morning declared Hon. Peter Ssematimba as the validly elected legislator of Busiro South.
This follows an appeal filed by Sematimba challenging High Court judge Lydia Mugambe’s ruling in which she nullified his election and ordered for fresh elections on grounds that he lacked the minimum education requirements needed for one to contest as an MP.
Stephen Sekigozi, one of the contestants in the 2016 Busiro South parliamentary elections challenged Peter Ssematimba’s victory on grounds that he lacked the minimum required Education requirements stated in the law to contest as an MP.
In July last year, Justice Lydia Mugambe faulted the National Council of Higher Education for failing to take due diligence to verify Sematimba’s diploma award from the Pacific Coast Institute in the USA before issuing him a certificate of A’Level equivalence that enabled him to participate in the election which he eventually won.
This is the basis that formed Justice Mugambe’s decision to nullify Sematimba’s victory and thus ordered for fresh Elections which Sematimba challenged in Kavuma’s court of Appeal.
This is one of the oldest election petitions from the 2016 general elections and had started raising suspicions in the public about why it was being treated differently by the appellant court.
